With the impacts of new development on our environment becoming more complex by the day, and at the same time the population becoming acutely more sensitive, the need for careful assessment at the application stage has never been greater.

Town & Country Planning legislation is supported by volumes of policy documents in the form of Circulars, Secretary of State's Guidance Notes, and at a local level, Development Plans. These all have to be taken into consideration carefully when local planning authority's attempt to reconcile the seemingly impossible conflicts of, benefit to be gained, versus potential environmental impact. Accurate and confident advice is therefore paramount.

The law and guidance relating to planning and pollution control is particularly difficult. On the one hand the planning authority must make a judgement on the potential impact of development, whilst on the other it is told it must not impose its own views in contradiction of the relevant pollution control authority. This results in untold problems as, invariably, the pollution control authority are not sufficiently familiar with the planning process and fail to offer firm advice.

The end result is usually that the applicant's agent tell the pollution control authority it is not for them to comment on location. They then tell the planning authority that it is not for them to comment on pollution, as that will be dealt with by the pollution control authority under licence, permit, or whatever. As a result development is often inappropriately located or planned mitigation measures do not work, to the detriment of a generation of residents or the environment generally.
